Victor Akinsanmi and Oluwaseun “Mary” Ogunbameru have filed a lawsuit in Denton County against Fabulinus LLC, which operates as Kids 'R' Kids Learning Academy in Little Elm, and its franchisor, Kids 'R' Kids International Inc. The suit alleges negligence, gross negligence, and premises liability following an incident on November 5, 2025, in which a steel playground gate closed on their 21-month-old son’s right ring finger.
The family is seeking more than $1 million in actual damages along with exemplary damages and has requested a jury trial.
According to the legal filing, the injury occurred around 10:22 a.m. while the toddler was playing outside. A staff member is accused of causing the gate to strike the child’s hand, an event captured on the facility’s surveillance cameras. The impact partially amputated the fingertip and exposed bone.
Akinsanmi stated that upon arriving at the scene, he saw blood on his son’s body and hand and immediately prepared to transport him to emergency care. The child was subsequently seen by a primary care physician and then treated in an emergency room, where a surgeon shaved down the exposed bone and reconstructed tissue.
The missing portion of the finger could not be reattached, and the nail was lost in the injury.
The lawsuit claims the incident has resulted in permanent damage, disrupted sleep, and a fear of gates and doors. The family reports that the toddler, who previously used his right hand for feeding and other tasks, now relies more heavily on his left hand and requires assistance with daily activities. In March 2026, the child was diagnosed with acute post-traumatic stress disorder.
Ogunbameru noted that her son now avoids doors and gates, resists having his hand touched, and dislikes medical professionals. She expressed frustration with the daycare’s response, stating that staff minimized the severity of the injury and lacked empathy.
